Privacy Policy

Cloud Surgeon LLC (“Cloud Surgeon”) has set up this Privacy Policy (the “Privacy Policy” or “Policy”) to explain to you how your information is protected, collected, and used. Cloud Surgeon may update this Policy at any time. Cloud Surgeon will provide notice of materially significant changes to this Privacy Policy by posting notice on the Cloud Surgeon website located at https://www.thecloudsurgeon.com (the “Site”). This Privacy Policy applies to individuals who visit the Site, submit inquiries, or otherwise interact with Cloud Surgeon prior to entering into a formal client agreement. If you become a client, your information will also be governed by the terms of any separate agreement between you and Cloud Surgeon. By using the Site, you agree to all terms in this Privacy Policy, which is incorporated herein by reference.

Protecting Your Privacy

Cloud Surgeon uses commercially reasonable administrative, technical, and physical safeguards to protect your personal information. Cloud Surgeon will not share your personal information with third parties for marketing purposes without your prior consent except as stated in this Privacy Policy.

Cloud Surgeon, or people who post on the Site, may provide links to third-party websites, which may have different privacy practices. Cloud Surgeon is not responsible for, and does not have any control over, the privacy policies of those third-party websites, and encourages all users to read the privacy policies of each website visited.

The Site is intended for individuals over the age of 18. To become a client of Cloud Surgeon, you must contact Cloud Surgeon and sign a master services agreement with Cloud Surgeon. Use of the Site does not make you a client. The Site is for informational purposes only.

Use of the Site by Minors

Cloud Surgeon does not knowingly collect any information from persons under the age of 18 years of age.

Data Cloud Surgeon Collects

Cloud Surgeon may collect the following data:

  • name.
  • email address.
  • company information.
  • physical contact information, including physical address and phone number.
  • information that you enter into the Site.
  • billing and other information you provide to buy a service from Cloud Surgeon if you become a client of Cloud Surgeon.
  • dispute resolution, correspondence through the Site and/or correspondence sent to Cloud Surgeon by any other means (such as mail, email, contact forms online, telephone messages, etc.).
  • other supplemental information from third parties (for example, if there is a problem charging your credit card, Cloud Surgeon may receive information from the credit card company or Cloud Surgeon may request information from third parties with permission).

Cloud Surgeon processes personal information for legitimate business purposes, including providing services, responding to inquiries, complying with legal obligations, and improving the Site.

Cloud Surgeon sometimes collects your email address, for purposes such as sending confirmation emails, sending information about products and specials, and sending information about services that you have purchased. By giving your email to Cloud Surgeon, you consent to emails from Cloud Surgeon. For all marketing emails, you will have the opportunity to opt-out as required by law.

Cloud Surgeon sometimes collects your phone number. If you submit your phone number to Cloud Surgeon, you consent to being contacted by phone or text regarding your inquiry or services, as permitted by applicable law.

Cloud Surgeon is not responsible for any misuse of information by a third-party.

Cloud Surgeon may collect personal information if you provide it in feedback or comments or if you contact Cloud Surgeon directly. Information submitted through public areas of the Site is not treated as confidential. While Cloud Surgeon takes reasonable steps to protect information submitted through private forms or communications, the Site is not intended for the transmission of highly sensitive or confidential information. Please do not post anything on the Site that you would like to keep private.

Cloud Surgeon’s web logs collect standard web log entries for each page served, including your IP address, page URL, and timestamp. Web logs help Cloud Surgeon diagnose problems with our server, to administer the Site, and to otherwise provide Cloud Surgeon’s service to you. In addition, Cloud Surgeon may collect other information from your interaction with the Site, content, and advertising, including computer and connection information, statistics on page views, traffic to and from the Site, advertising data, IP address, demographic and navigational data, and standard web log information. Cloud Surgeon may obtain this information from a third-party provider. Cloud Surgeon may use this information for the purposes described in this Privacy Policy, including to operate the Site, provide services, communicate with users, comply with legal obligations, and support business operations.

Cloud Surgeon may use your information to:

  • respond to inquiries and provide requested information
  • deliver services (if applicable)
  • process payments
  • send administrative communications
  • send marketing communications (subject to opt-out rights)
  • improve the Site and user experience

The Site does not currently respond to Do Not Track signals.

Data Cloud Surgeon Stores

Cloud Surgeon may retain certain information as necessary to comply with legal obligations, resolve disputes, and enforce agreements, even after a user requests deletion. In addition, Cloud Surgeon may archive this information elsewhere as well.

Web logs and other records are retained only as long as reasonably necessary for business or legal purposes. This may include information about the products and services you bought and your browsing history.

Although Cloud Surgeon makes good-faith efforts to store the information in a secure operating environment that is not available to the public, Cloud Surgeon cannot guarantee complete security.

Cloud Surgeon may store information in an off-site location, which may or may not be in the United States and may not be bound by the laws of the United States.

If you become a client of Cloud Surgeon, the information stored about you and/or your business may increase to include any information that is supplied to receive services from Cloud Surgeon.

Archiving and display of Cloud Surgeon’s web pages by search engines and other sites

Search engines and other sites not affiliated with Cloud Surgeon - including Google.com, Bing.com and Yahoo.com - archive or otherwise make available Cloud Surgeon’s web pages. Cloud Surgeon has no control over third-party archiving and search engine sites and cannot guarantee the accuracy of any information stored by search engine sites.

Depending on your jurisdiction, you may have the right to:

  • request access to your personal information
  • request correction or deletion
  • opt out of marketing communications
  • request information about how your data is used

Circumstances in which Cloud Surgeon may release information

Cloud Surgeon may disclose information about its users if required to do so by law or in the good-faith belief that such disclosure is necessary to respond to subpoenas, court orders, or other legal process.

Cloud Surgeon may disclose information about its users to law enforcement officers or others, in the good-faith belief that such disclosure is reasonably necessary to: enforce our Terms of Use; respond to claims that any posting or other content violates the rights of third parties; or protect the rights, property, or personal safety of Cloud Surgeon, its users, or the general public.

Cloud Surgeon may disclose information about payment information if there is a dispute over payments made to Cloud Surgeon.

Cloud Surgeon may disclose your information to third parties for use by Cloud Surgeon. This may include disclosure to email marketing providers to provide targeted marketing for our users.

If you do not wish to receive email marketing from Cloud Surgeon, you will have the choice to unsubscribe from the service.

Cloud Surgeon may disclose your information to other business entities if a business entity plans to merge with Cloud Surgeon or buy Cloud Surgeon.

If you become a client of Cloud Surgeon, additional reasons that Cloud Surgeon may disclose your information may be agreed to via separate agreement between you and Cloud Surgeon.

Cloud Surgeon may share information with third-party service providers that assist in operating the Site and providing services (such as hosting providers, email platforms, and payment processors), subject to appropriate confidentiality obligations.

International Users

Cloud Surgeon’s services are only available to users located in the United States at this time. By using the Site, you are representing to Cloud Surgeon that you are located in the United States.

Cookies

A cookie is a string of information that a website stores on a visitor’s computer, and that the visitor’s browser provides to the website each time the visitor returns. We use cookies to help us identify and track visitors, their usage of our websites, and their website access preferences. Users who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before using the Site, with the drawback that certain features of the Site may not function properly without the aid of cookies. Cookies may be used for analytics, functionality, and marketing purposes.

Client Agreement

If you become a client, your information will also be governed by a separate agreement. In the event of a conflict between this Privacy Policy and the Mast Services Agreement, the Master Services Agreement will control. Further, you agree and acknowledge that information supplied to Cloud Surgeon as a client may have different privacy settings than those under this Agreement.
